Hereinafter referred to as “the Seller”.
Article 2 – Purpose
These Terms and Conditions of Sale govern purchases made through the Waverly & James website.
By placing an order, the customer acknowledges having read and accepted these Terms and Conditions of Sale.
Nothing in these Terms limits or excludes any mandatory consumer rights applicable to the customer.
Article 3 – Products
The products offered for sale are those displayed on the Site at the time the order is placed.
Each product page includes a description of the product’s main characteristics.
Images, photographs, videos, illustrations, mock-ups and other visual representations are intended to present and illustrate the products.
They may include demonstration images, lifestyle photography, simulations, digital renderings or marketing representations.
Minor differences in colour, packaging, accessories, finishes or presentation may occur, particularly due to lighting, screen settings, photography or normal manufacturing variations.
Such minor differences do not constitute a lack of conformity where they do not materially affect the characteristics of the product as described or otherwise required by applicable consumer law.
Nothing in this Article excludes or restricts the customer’s statutory rights where goods are faulty, materially not as described or otherwise do not conform to the contract.
Article 4 – Prices
All prices are displayed in Pounds Sterling (£) and include applicable taxes where required.
Delivery charges, where applicable, are displayed before payment.
The Seller reserves the right to modify prices at any time.
Products are invoiced according to the price displayed and applicable at the time the order is confirmed.
Article 5 – Orders
An order becomes binding once:
• Payment has been successfully authorised; and
• The customer has accepted these Terms and Conditions of Sale.
An order confirmation email will then be sent.
The Seller reserves the right to refuse or cancel an order where permitted by applicable law, including in cases of suspected fraud, payment issues or other legitimate reasons.
Article 6 – Payment
Payments are securely processed through Shopify Payments and any other payment methods made available on the Site.
The Seller does not have access to customers’ full payment card details.
Orders are processed once payment has been successfully confirmed.
Article 7 – Delivery
Products are delivered to the delivery address provided by the customer during checkout.
Estimated delivery time for the United Kingdom:
7–13 business days.
Orders are generally dispatched within approximately 24–48 hours after payment confirmation.
In any event, delivery will take place within the maximum period required by applicable consumer law.
If an order is not delivered within the applicable legal timeframe, the customer may exercise any cancellation and refund rights available under applicable consumer protection law.
Risk in the goods passes to the customer when the customer, or a person designated by the customer other than the carrier, takes physical possession of the goods, subject to applicable law.
Article 8 – Right of Withdrawal
Customers have a statutory right to withdraw from an eligible distance purchase within 14 calendar days from the date they receive the goods, without having to provide a reason, subject to any exceptions provided by applicable law.
As an additional commercial benefit, Waverly & James offers a voluntary 30-day return period. Full details are available in our Returns & Refunds Policy.

Customers may use the model withdrawal form below, but its use is not mandatory.
Unless otherwise required by applicable law, customers exercising a change-of-mind right of withdrawal are responsible for the direct cost of returning the goods where they were informed of this obligation.
Customers may handle or inspect the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. Any reduction in value resulting from handling beyond what is reasonably necessary may be deducted where permitted by applicable law.
Where reasonably possible, customers are encouraged to return products complete and with their original packaging.
Refunds following a valid statutory withdrawal will be processed within the timeframe required by applicable consumer law. Where legally permitted, reimbursement may be withheld until the goods have been received or the customer provides evidence of having sent them back, whichever occurs first.

Article 9 – Legal Guarantees and Non-Conforming Goods
Customers benefit from the statutory consumer rights applicable to their purchase, including mandatory consumer protections that cannot legally be excluded or restricted.
Where goods are faulty, damaged, materially not as described, incorrect or otherwise do not conform to the contract, the customer may be entitled to remedies provided by applicable consumer law, which may include repair, replacement, price reduction or refund depending on the circumstances.
Where applicable consumer law requires the Seller to bear reasonable costs associated with returning qualifying faulty or non-conforming goods, those costs will be handled accordingly.
A claim that a product is faulty or not as described will be assessed based on the circumstances of the individual case, including the product information available at the time of purchase and any relevant evidence provided.
Nothing in these Terms limits or excludes statutory consumer rights that cannot legally be limited or excluded.
Article 10 – Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.
Subject to applicable law, the Seller shall not be liable for losses resulting from:
• Misuse of the products;
• Events outside the Seller’s reasonable control;
• Indirect or consequential losses where such liability may lawfully be excluded or limited.
Nothing in this Article affects the customer’s mandatory statutory rights.
Article 11 – Force Majeure
The Seller shall not be liable for failure or delay in performing contractual obligations where this results from events beyond the Seller’s reasonable control, including circumstances constituting force majeure within the meaning of Article 1218 of the French Civil Code.
This Article applies only to the extent permitted by applicable consumer law.

The parties will seek to resolve the matter amicably wherever possible.
As the Seller is established in France, consumers may have access to a consumer mediation procedure in accordance with applicable French consumer law.
The Seller is currently updating the information relating to its designated consumer mediation service. The details of the competent consumer mediator will be published on the Site and in these Terms and Conditions of Sale once the relevant arrangements have been completed.
Nothing in this Article limits any other statutory rights or remedies available to consumers.
Article 13 – Personal Data
Personal data is processed in accordance with applicable data protection legislation, including the EU GDPR and, where applicable, the UK GDPR.

Article 14 – Governing Law and Disputes
These Terms and Conditions of Sale are governed by French law.
However, nothing in these Terms deprives consumers of any mandatory consumer protection rights they may benefit from under the laws applicable to them, including mandatory protections applicable in their country of residence where relevant.
The parties will first seek an amicable resolution to any dispute.
Any dispute that cannot be resolved amicably may be submitted to the competent courts in accordance with applicable rules governing jurisdiction and consumer protection.
Nothing in this Article restricts a consumer’s right to bring proceedings before a court that has jurisdiction under mandatory applicable law.
